1. Scope of Services

Front Door Festive (“Company”) agrees to provide front door and outdoor décor services as described in the attached proposal (“Services”). Any additional requests outside the scope of Services may require a separate agreement and additional fees.

2. Booking, Payment, and Rescheduling

Full payment at time of booking is needed to secure your booking.

Payments are 50% refundable through September 15, 2026. No refunds will be granted after October 3, 2026 as the Company will have purchased materials by this date.

Rescheduling is subject to availability and may require additional charges if materials have been purchased.

3. Scheduling & Access

Client agrees to provide the Company reasonable access to the property to complete Services. The Company is not responsible for delays caused by weather, property restrictions, lack of access, or circumstances beyond the Company’s control. Clients do not need to be present for all outdoor deliveries, as long as the Company has clear access to set-up location.

4. Materials & Ownership

All décor materials (pumpkins, hay bales, corn stalks, etc.) become the property of the Client upon installation unless otherwise stated. The Company is not responsible for natural deterioration of décor materials (rot, pests, weather-related damage) or damage to property caused by natural deterioration of décor materials after installation. The Company is not responsible for removal of décor materials when Client has completed its use of décor materials, unless pickup services are purchased.

5. Limitation of Liability

Except for liability arising from Company’s gross negligence, willful misconduct, or fraud, or as restricted by applicable law, in no event shall Company be liable to Client for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits or loss of business opportunity.

Except as limited by applicable law, the Company is not liable for:

Damage caused by pre-existing property conditions or hidden hazards.

Damage caused by natural deterioration of décor items.

Injuries to persons or animals interacting with décor after installation.

Weather events, theft, vandalism, or misuse of décor items.

Furthermore, except as governed by applicable law, the Company’s total cumulative liability under this Agreement shall not exceed the total fees paid by the Client to the Company under this Agreement.

Services are provided ‘as-is’ without any express or implied warranties.

6. Indemnification

Client agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and contractors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Client’s use of the Services or décor;

Any breach of this Agreement by Client;

Any negligent or intentional act or omission of Client or its representatives.

This indemnity shall survive the completion of Services and/or termination of this Agreement.

7. Photography & Marketing

Unless otherwise requested in writing, Client grants Company the right to photograph the décor and use images for marketing and promotional purposes.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.
